FOR IMMEDIATE RELEASE November 11, 1996 Baarn, the Netherlands Cordon Art B.V. and the M.C. Escher Foundation announced today the successful resolution of their copyright infringement lawsuit against Rock Walker following the court s recent ruling that the Escher works in question are fully protected by copyright in the United States. As the exclusive holder throughout the world of all copyrights in works by the well-known Dutch artist M.C. Escher (1898-1972), Cordon Art licenses Escher images for products and other uses. Cordon Art works closely with the M.C. Escher Foundation, the not-for-profit organization that the artist set up in the years before his death to preserve and maintain his artistic legacy. Last year, after Mr. Walker refused to cease creating and selling unauthorized reproductions of M.C. Escher images, Cordon Art and the M.C. Escher Foundation filed suit against him in U.S. federal court in the Southern District of California (Cordon Art B.V. v. R. Jerome Walker Case No. 95-0863). In a decision dated August 12, 1996, the district court found that Mr. Walker had infringed Cordon Art s copyrights and rejected his claim that the Escher works in question were no longer protected in the United States. Mr. Walker had argued that the works had passed into the public domain in the U.S. and that he was therefore free to reproduce them without obtaining Cordon Art s permission. However, the court found that since none of the underlying Escher images had at any time entered the public domain, all of the images in question were fully protected by U.S. copyright. The court also held that even if Mr. Walker s claim had been correct, copyright protection would have been fully restored in any event under the new U.S. legislation implementing GATT. The litigation has now been brought to final resolution by the recent issuance of a consent judgment that permanently enjoins Mr. Walker from reproducing Escher images and orders him to turn over to Cordon Art his entire inventory of unlicensed Escher products. The accompanying settlement agreement also requires Mr. Walker to pay substantial damages to Cordon Art in the form of original works of art. Cordon Art and the M.C. Escher Foundation were represented by the law firm of Stout & Thomas (New York). With the firms of Weiss Dawid Zelnick & Lehrman, P.C. (New York) and Solomon Ward Seidenwurm & Smith (San Diego) acting as special council.
